Peki pandemi s\u00fcrecinde kamuoyunda <em>\u201cSa\u011fl\u0131kta \u015eiddet Yasas\u0131\u201d<\/em> ad\u0131yla an\u0131lan, \u015fiddeti engellemeye y\u00f6nelik g\u00fcncel d\u00fczenleme nedir ve yetersiz kald\u0131\u011f\u0131 noktalar nelerdir, bug\u00fcn sizlere biraz bundan bahsetmek istiyorum\u2026<\/p>\n\n\n<p><strong>\u201cBahsedilen d\u00fczenlemenin yeni oldu\u011funu sanmay\u0131n asl\u0131nda 1987\u2019de y\u00fcr\u00fcrl\u00fc\u011fe girmi\u015f\u201d<\/strong><\/p>\n\n\n<p>Pandemi s\u00fcreci boyunca <em>\u201cSa\u011fl\u0131kta \u015eiddet Yasas\u0131\u201d <\/em>olarak bahsedilen d\u00fczenleme, asl\u0131nda 1987 senesinde y\u00fcr\u00fcrl\u00fc\u011fe girmi\u015f olan 3359 Say\u0131l\u0131 <strong><em>\u201cSa\u011fl\u0131k Hizmetleri Temel Kanunu\u201dnun 12. maddesine eklenen baz\u0131 cezai yapt\u0131r\u0131mlard\u0131r.\u00a0<\/em><\/strong><\/p>\n\n\n\n<p class=\"has-text-align-center has-cyan-bluish-gray-background-color has-background\"><strong><em>\u201cSa\u011fl\u0131k personelini kasten yaralama tutuklanma sebebi\u201d<\/em><\/strong><\/p>\n\n\n\n<p>12. maddenin ilk haline 2014 senesinde ekleme yap\u0131lm\u0131\u015ft\u0131r. Getirilen yenilikle; sa\u011fl\u0131k kurulu\u015flar\u0131nda \u00e7al\u0131\u015fan personele kar\u015f\u0131, g\u00f6revleri s\u0131ras\u0131nda veya g\u00f6revleri sebebiyle <strong><em>\u201ckasten yaralama su\u00e7u\u201d<\/em>nun i\u015flenmesi tutuklama sebebi<\/strong> olarak d\u00fczenlenmi\u015ftir. 2018 y\u0131l\u0131nda bu maddeye, <em>\u201cbeyaz kod\u201d<\/em> konulu b\u00fclten yaz\u0131m\u0131zda incelemi\u015f oldu\u011fumuz bir d\u00fczenleme daha eklendi.\u00a0<\/p>\n\n\n\n<p class=\"has-text-align-center has-cyan-bluish-gray-background-color has-background\"><strong><em>\u201c\u0130fade vermek i\u00e7in karakola gitmek zorunda de\u011filsiniz\u201d<\/em><\/strong><\/p>\n\n\n\n<p>Tekrar bahsedecek olur isek; \u00f6zel veya kamu sa\u011fl\u0131k kurum\/kurulu\u015flar\u0131ndaki personele kar\u015f\u0131 g\u00f6revleri sebebi ile <strong>\u201ckasten\u201d i\u015flenen t\u00fcm su\u00e7larda<\/strong>, \u015f\u00fcpheli, kolluk g\u00fc\u00e7lerince <strong>yakalanarak savc\u0131 kar\u015f\u0131s\u0131na \u00e7\u0131kar\u0131lmal\u0131d\u0131r. Ayr\u0131ca m\u00fc\u015fteki, ma\u011fdur ya da tan\u0131k sa\u011fl\u0131k \u00e7al\u0131\u015fan\u0131n\u0131n ifadesi i\u015fyerinde al\u0131nmal\u0131d\u0131r.<\/strong><\/p>\n\n\n\n<hr class=\"wp-block-separator is-style-wide\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong><em>Konu ile ilgili son de\u011fi\u015fiklikler neler?<\/em><\/strong><\/h2>\n\n\n\n<p><strong>Nisan 2020\u2019de y\u00fcr\u00fcrl\u00fc\u011fe giren g\u00fcncel de\u011fi\u015fikliklerde bu maddeye iki yeni f\u0131kra eklendi.&nbsp;<\/strong><\/p>\n\n\n\n<p>Biri sald\u0131r\u0131ya <strong><em>maruz kalan sa\u011fl\u0131k \u00e7al\u0131\u015fan\u0131n\u0131<\/em><\/strong>, di\u011feri ise <strong><em>hasta haklar\u0131n\u0131<\/em><\/strong> korumaya y\u00f6nelik g\u00f6r\u00fcn\u00fcyor.<\/p>\n\n\n\n<p class=\"has-text-align-center has-cyan-bluish-gray-background-color has-background\"><strong><em>\u201cSa\u011fl\u0131k personeline kar\u015f\u0131 i\u015flenen su\u00e7ta %50 art\u0131r\u0131m\u201d<\/em><\/strong><\/p>\n\n\n\n<p><strong><em>\u00d6nce ma\u011fdur taraftan bahsetmek istiyorum;&nbsp;<\/em><\/strong><\/p>\n\n\n\n<p>\u00d6zel ya da kamu ay\u0131rt etmeksizin t\u00fcm sa\u011fl\u0131k personeli ve yard\u0131mc\u0131 sa\u011fl\u0131k personeline kar\u015f\u0131 g\u00f6rev sebebiyle i\u015flenen <em>kasten yaralama, hakaret, tehdit, g\u00f6revi yapt\u0131rmamak i\u00e7in direnme<\/em> su\u00e7lar\u0131nda, verilecek cezada <strong>yar\u0131 oran\u0131nda art\u0131r\u0131m<\/strong> uygulanaca\u011f\u0131 yasal olarak kabul edilmi\u015ftir. Bu d\u00fczenlemede, verilecek cezan\u0131n <strong>ertelenmeyece\u011fi<\/strong> belirtilmi\u015ftir ki bu ilgin\u00e7 bir yenilik, ancak kula\u011fa geldi\u011fi kadar etkili de\u011fil. \u00c7\u00fcnk\u00fc erteleme dedi\u011fimiz \u015fey, HAGB (h\u00fckm\u00fcn a\u00e7\u0131klanmas\u0131n\u0131n geri b\u0131rak\u0131lmas\u0131) ile ayn\u0131 \u015fey de\u011fil. Onu da birazdan a\u00e7\u0131klayaca\u011f\u0131m.<\/p>\n\n\n\n<p class=\"has-text-align-center\"><strong><em>\u201c\u00d6zel kurulu\u015flardaki sa\u011fl\u0131k personelleri de kapsam i\u00e7erisinde\u201d<\/em><\/strong><\/p>\n\n\n\n<p>Ayr\u0131ca kamu g\u00f6revlisi s\u0131fat\u0131na sahip olmamas\u0131 nedeniyle bazen kapsam d\u0131\u015f\u0131nda kalan \u00f6zel sa\u011fl\u0131k kurulu\u015flar\u0131nda \u00e7al\u0131\u015fan personel de unutulmam\u0131\u015f, ayn\u0131 \u015fekilde bu su\u00e7lara maruz kalmas\u0131 halinde, kamu g\u00f6revlisi say\u0131laca\u011f\u0131 \u00f6ng\u00f6r\u00fclm\u00fc\u015ft\u00fcr.<\/p>\n\n\n\n<p class=\"has-text-align-center has-cyan-bluish-gray-background-color has-background\"><strong><em>\u201c\u015eiddet olay\u0131nda \u015f\u00fcpheliye sa\u011fl\u0131k bak\u0131m\u0131 hizmetini ba\u015fka birinin yapmas\u0131 \u00f6neriliyor\u201d<\/em><\/strong><\/p>\n\n\n\n<p><strong><em>F\u0131kran\u0131n ikinci k\u0131sm\u0131na gelirsek, hasta haklar\u0131 y\u00f6n\u00fcnden ise;<\/em><\/strong><\/p>\n\n\n\n<p>\u015e\u00fcpheli yahut \u015f\u00fcphelinin yak\u0131n\u0131na, <em>\u201cayn\u0131 bak\u0131m\u0131 yapabilecek ba\u015fka bir sa\u011fl\u0131k personeli taraf\u0131ndan bak\u0131l\u0131r\u201d<\/em> demek suretiyle koruma getirilmi\u015ftir. Bu maddeye, \u00f6zellikle, sald\u0131rgan \u015fah\u0131s e\u011fer ki hasta yak\u0131n\u0131 ise, su\u00e7u olmad\u0131\u011f\u0131 halde arada kalan hasta a\u00e7\u0131s\u0131ndan \u00f6nemli diyebiliriz. Ayr\u0131ca, sald\u0131rgan\u0131n ayn\u0131 ma\u011fdur sa\u011fl\u0131k \u00e7al\u0131\u015fan\u0131na gelmesi halinde; o ma\u011fdurun art\u0131k hakl\u0131 olarak objektif bakamayaca\u011f\u0131 ve o ruh haliyle baz\u0131 \u015feyleri g\u00f6zden ka\u00e7\u0131rabilece\u011fi i\u00e7in, hukuki sorumlulu\u011funun do\u011fmas\u0131n\u0131 da \u00f6nleyecektir.\u00a0<\/p>\n\n\n\n<p class=\"has-text-align-center\"><strong><em>\u201cRed hakk\u0131 ile \u00e7eli\u015fki aras\u0131ndaki ikilem\u201d<\/em><\/strong><\/p>\n\n\n\n<p>Her ne kadar hekimin hakl\u0131 durumlarda hastay\u0131 red hakk\u0131 olsada, bu d\u00fczenleme sayesinde \u00e7eli\u015fkiye yer b\u0131rakmaks\u0131z\u0131n muhatap olunmas\u0131 gerekmeyecektir.<\/p>\n\n\n\n<p class=\"has-text-align-center has-cyan-bluish-gray-background-color has-background\"><strong>\u201c\u015e\u00fcpheli tutuklan\u0131p, savc\u0131 ve hakim kar\u015f\u0131s\u0131na \u00e7\u0131kar\u0131lmal\u0131\u201d<\/strong><\/p>\n\n\n\n<p><strong>\u015e\u00fcphelinin tutuklanmas\u0131 meselesine gelince;<\/strong> yeni eklemeler sayesinde, eskiden karakolda ifade verip serbest kalan \u015fahs\u0131n, art\u0131k emniyetteki ifadesiyle yetinilemeyece\u011fi, devam\u0131nda adliyeye sevk edilerek savc\u0131 ve sorgu hakimi kar\u015f\u0131s\u0131na \u00e7\u0131kar\u0131lmas\u0131 gereklili\u011fi s\u00f6z konusu.<\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong><em>\u201cBu konuda maalesef ki ciddi bir bask\u0131 olu\u015fturmak \u015fart\u201d<\/em><\/strong><\/p>\n\n\n\n<p>Ne yaz\u0131k ki g\u00fcn\u00fcm\u00fczde hala, sosyal medya\/kamuoyu bask\u0131s\u0131 olu\u015fmadan veya ma\u011fdur avukat\u0131 olay\u0131 takiben emniyete gidip de yasa b\u00f6yle demiyor diye \u0131srar etmedi\u011fi s\u00fcrece, bu m\u00fcjdelenen(!) de\u011fi\u015fikli\u011fin uyguland\u0131\u011f\u0131n\u0131 g\u00f6rmedim.<\/p>\n\n\n\n<hr class=\"wp-block-separator is-style-wide\"\/>\n\n\n\n<h2 class=\"wp-block-heading\"><strong>Peki ertelenme karar\u0131 HAGB ile ayn\u0131 anlama m\u0131 geliyor?<\/strong><\/h2>\n\n\n\n<p>Son s\u00f6yleyece\u011fimi en ba\u015fta belirteyim: <strong>HAYIR<\/strong><\/p>\n\n\n\n<p>Erteleme cezan\u0131n ertelenmesi, HAGB (H\u00fckm\u00fcn A\u00e7\u0131klanmas\u0131n\u0131n Geri B\u0131rak\u0131lmas\u0131) ise infaz\u0131n ertelenmesidir. \u0130kisi hukuken farkl\u0131 anlamlara gelir. Basit bir \u015fekilde a\u00e7\u0131klamam gerekirse; HAGB\u2019de 5 y\u0131l boyunca herhangi bir su\u00e7 i\u015flememesi halinde san\u0131k, o su\u00e7u hi\u00e7 i\u015flememi\u015f kabul ediliyor. Erteleme karar\u0131nda ise; san\u0131k, hakim taraf\u0131ndan uygun g\u00f6r\u00fclen belli bir s\u00fcrede ve baz\u0131 yapt\u0131r\u0131mlarla cezaevi d\u0131\u015f\u0131nda cezas\u0131n\u0131 \u00e7ekiyor.<\/p>\n\n\n\n<p class=\"has-text-align-left\"><strong><em>\u201cErteleme HAGB\u2019den daha b\u00fcy\u00fck bir yapt\u0131r\u0131m asl\u0131nda\u201d<\/em><\/strong><\/p>\n\n\n\n<p>Erteleme karar\u0131; velayet\/vesayet haklar\u0131, memuriyet vb haklar \u00fczerinde sonu\u00e7 do\u011furabilme \u00f6zelli\u011fi ile, HAGB\u2019ye g\u00f6re daha b\u00fcy\u00fck bir yapt\u0131r\u0131m olarak kabul edilir.<strong> <\/strong>Yeni de\u011fi\u015fiklikte bahsedilen erteleme, cezan\u0131n ertelenmesidir. Oysaki, sa\u011fl\u0131k \u00e7al\u0131\u015fanlar\u0131na sald\u0131ran bu \u015fah\u0131slar y\u00f6n\u00fcnden erteleme yerine HAGB uygulamas\u0131n\u0131n kald\u0131r\u0131lmas\u0131 ger\u00e7ekten b\u00fcy\u00fck de\u011fi\u015fiklik yarat\u0131rd\u0131. Malumunuz, san\u0131\u011f\u0131n sicili temizse \u201cnas\u0131l olsa bir anlam\u0131 yok\u201d bak\u0131\u015f a\u00e7\u0131s\u0131yla fail cesaret buluyor, ma\u011fdur ise umutsuzlu\u011fa kap\u0131l\u0131yor, bence bu konu \u00fczerine e\u011filmek ger\u00e7ekten faydal\u0131 olurdu.&nbsp;<\/p>\n\n\n\n<p>Mevcut yasal d\u00fczenlemenin yetersiz kald\u0131\u011f\u0131 noktalar mevcut. Cayd\u0131r\u0131c\u0131 \u00f6zellikleri s\u00f6z konusu. Ne var ki, mevcut olan da keyfi olarak uygulanmay\u0131nca hi\u00e7bir cayd\u0131r\u0131c\u0131l\u0131\u011f\u0131 kalm\u0131yor.\u00a0<\/p>\n\n\n\n<p class=\"has-text-align-center has-cyan-bluish-gray-background-color has-background\"><strong><em>\u201cCayd\u0131r\u0131c\u0131l\u0131k i\u00e7in yeterli uygulama gerekir\u201d<\/em><\/strong><\/p>\n\n\n\n<p>E\u011fer ki, yasa tersini \u00f6ng\u00f6rd\u00fc\u011f\u00fc halde; sa\u011fl\u0131k personelini tehdit eden \u015fah\u0131s savc\u0131l\u0131\u011fa sevk edilmeyip yar\u0131m saat sonra elini kolunu sallayarak hastaneye d\u00f6n\u00fcyor, doktorun kar\u015f\u0131s\u0131na \u00e7\u0131k\u0131yorsa; sa\u011fl\u0131k personelinin ifadesi i\u015fyerinde al\u0131nm\u0131yor ertesi g\u00fcn \u0131srar k\u0131yamet karakola \u00e7a\u011f\u0131r\u0131l\u0131yorsa; sald\u0131rgan, personeli yaralad\u0131\u011f\u0131nda yasa tutuklanmas\u0131n\u0131 \u00f6ng\u00f6rd\u00fc\u011f\u00fc halde serbest b\u0131rak\u0131l\u0131yorsa; verilen kararda HAGB uygulan\u0131yor ise <strong><em>yasalar ne i\u00e7in var?\u00a0<\/em><\/strong><\/p>\n\n\n\n<p class=\"has-text-align-left has-medium-font-size\"><strong><em>\u201c\u0130\u015f yine ba\u015fa d\u00fc\u015f\u00fcyor!\u201d<\/em><\/strong><\/p>\n\n\n\n<p>Kanayan yara haline gelmi\u015f b\u00f6ylesi \u00f6nemli bir konuda, haklar\u0131n\u0131z\u0131 bilmeniz \u00e7ok \u00f6nemli.
